How the RiteWay Transaction
Actually Works.
These terms explain the roles, responsibilities and expectations for every RiteWay-coordinated transaction. Please review them before you activate your purchase.
RiteWay markets homes available through independent dealers, builders, manufacturers and other fulfillment partners. RiteWay assists with the initial transaction, prepares and coordinates the required documents, and may transfer or assign the transaction to the appropriate partner for completion. RiteWay acts as a transaction coordinator and is not the manufacturer, builder, installer, transporter or lender for the home unless expressly stated in writing.
Dealers, builders, manufacturers, lenders, installers, transporters and other fulfillment providers participating in the RiteWay network may be independently owned and operated. Each partner is responsible for the products and services it agrees to provide. RiteWay does not control, and is not responsible for, the acts or omissions of independent partners.
Preliminary pricing, estimated payments, rates, delivery estimates, timelines, site-work estimates and similar figures are based on information available at the time they are provided. They are estimates only and may be adjusted following final review and confirmation by the applicable partner. No preliminary figure is a guarantee or a final term until confirmed in writing.
The standard Purchase Activation Payment is $3,500. This payment activates RiteWay's preparation and coordination of your transaction, including document preparation, home coordination, and preparation of your transaction for placement with the appropriate fulfillment partner. The Purchase Activation Payment is considered earned when paid in exchange for the services RiteWay performs to initiate and coordinate the transaction. If the transaction changes, is cancelled, or cannot be transferred to a fulfillment partner, the treatment of the Purchase Activation Payment is governed by the Cancellation & Refund Policy and your Commitment to Purchase.
The price presented by RiteWay is the customer's stated purchase price for the home and may include RiteWay's compensation or margin. Where the $3,500 Purchase Activation Payment is represented as applied against the stated purchase price, it is applied consistently with your Commitment to Purchase and the final transaction documents prepared by the fulfilling partner. Final pricing is confirmed by the applicable partner during the fulfillment process.
When the customer signs the Commitment to Purchase, the customer authorizes RiteWay to begin processing the transaction, preparing and coordinating documents, and preparing the transaction for transfer to the appropriate fulfillment partner. Signing the Commitment to Purchase does not obligate the customer to accept final terms that materially differ from those presented, as addressed under Partner Acceptance.
The customer authorizes RiteWay to assign or transfer its contractual interest and transaction documentation to a participating dealer, builder, manufacturer or other fulfillment partner where permitted by law. This assignment allows the receiving partner to complete the portions of the transaction assigned to it.
Once the applicable transfer or assignment is accepted by a fulfillment partner, the receiving partner handles the portions of the transaction assigned to it. This may include final documents, final pricing, financing, manufacturing or construction, delivery, setup, closing, warranties and ongoing service. RiteWay's coordination role concludes upon successful transition of the transaction to the fulfillment partner.
The customer authorizes RiteWay to transmit information reasonably necessary to process the transaction to the selected fulfillment partner and relevant service providers. This authorization is limited to information needed to complete the transaction. The broader collection, use and protection of personal information is addressed in RiteWay's separate Privacy Policy.
RiteWay is not a lender. Financing availability and final financing terms are determined by the applicable financing provider and are subject to its review, underwriting and requirements. Any financing figures provided by RiteWay are preliminary estimates only and are not a commitment to lend. The customer's Financing Application is a preliminary breakdown and not a loan approval.
Floor plans, colors, options, specifications, dimensions, photos and renderings are for illustration and may vary from the actual home. Manufacturers may make changes to products, materials, specifications and features, and substitutions may occur. Marketing materials are not guarantees of final specifications. Final specifications are confirmed by the applicable manufacturer or builder in writing.
Delivery, setup, foundation, utility connections, permits, grading, inspections, site preparation and similar items are included only when specifically stated in writing in your transaction documents. Unless expressly included, these items are the responsibility of the customer or are arranged separately with the fulfillment partner.
Estimated manufacturing, delivery, installation, financing and completion dates are expressly estimates unless a specific written agreement guarantees a particular date. Actual timelines depend on partner availability, production schedules, site readiness, permitting, weather and other factors outside RiteWay's control.
Customer cancellation: A customer may cancel the transaction as provided in the Commitment to Purchase. RiteWay cancellation: RiteWay may cancel if a fulfillment partner cannot be secured on reasonable terms or if required information is not provided. Partner rejection or inability to fulfill: If the originally contemplated partner cannot fulfill the transaction, RiteWay may seek an alternative partner. Refunds, if any, depend on the stage of the transaction and the work already performed. The Purchase Activation Payment is earned for coordination services performed and is refundable only to the extent stated in the Commitment to Purchase. Where work has already been performed or costs incurred, applicable amounts may be retained. The specific timing and amount of any refund are governed by the Commitment to Purchase and applicable law.
If the originally contemplated vendor does not accept the transaction, RiteWay may seek an alternative fulfillment partner. If the alternative partner's terms are materially different from those originally presented, the customer is not obligated to proceed and may cancel as provided in the Commitment to Purchase. The customer's acceptance of materially different terms must be confirmed in writing.
The customer agrees to provide accurate information, submit required documents in a timely manner, maintain communication with RiteWay and the fulfillment partner, provide property and site access when applicable, meet the partner's reasonable requirements, and review and sign final documents promptly.
Sales conversations, oral statements and marketing materials do not override signed documents or these published terms. Material changes to the transaction must be documented in writing or electronic form to be effective.
The customer consents to electronic agreements, acknowledgments, notices and signatures. Electronic signatures and records have the same legal effect as handwritten signatures and paper records.
These terms and any transaction under them are governed by the laws of the State of New Mexico, without regard to conflict of law principles. The parties consent to the exclusive venue of the courts located in Bernalillo County, New Mexico, for any dispute arising from the transaction. Each party bears its own attorney fees unless a court awards otherwise. Any arbitration, if elected, is addressed in the Commitment to Purchase. Required consumer notices, if any, are provided as required by applicable law.
RiteWay is responsible for its own coordination and document preparation services. RiteWay is not responsible for independently provided services, including manufacturing, construction, installation, delivery, financing or warranty work performed by fulfillment partners. Nothing in these terms waives any liability that cannot legally be waived under applicable law, including any non-waivable consumer protections.
These terms are provided for general information and do not replace the specific terms in your Commitment to Purchase or final transaction documents. In the event of a conflict, your signed agreement controls.
